General Terms and Conditions

1. General Scope
Dr. Hajo Horst (hereinafter referred to as coach) conducts coaching, online courses, general personal and business consultations, workshops, and other events in accordance with these General Terms and Conditions (GTC). These terms are to be accepted by the client. Any deviations from these conditions must be agreed upon in writing. Different terms and conditions to not apply to the client unless these have been explicitly agreed upon in writing.

2. Contract Conclusion
A contract is concluded between the client and the coach when the client places an order and the coach accepts the order. This order can be placed by the client and accepted by the coach via email, in writing, via WhatsApp, or through a booking platform.

3. Differentiation to Psychotherapy
Dr. Hajo Horst is a qualified psychologist and therapist, but does neither present as such on his website or in the United Arab Emirates, nor does he replace a psychologist or therapist. Coaching is based on a coach-client relationship which acts as a partnership and thus clearly differentiates the role of the coach from therapists and doctors. Psychotherapy is problem-and-symptom oriented, dealing with the past to heal old wounds. Coaching is solution oriented, dealing with the present and future. Psychotherapy is the targeted treatment of mental illness. Coaching serves “healthy” people who are capable of action and self-reflection. The result of coaching does not represent the relief of psychological complaints, but rather the individual development of the client, which is accompanied by an increase in the client’s general quality of life. Every client is responsible for themselves before, during, and after the coaching. By entering into a coaching agreement, the client confirms that they feel mentally and physically healthy and can partake in the coaching process. By placing the order, the client also explicitly declares that they have read and understood the General Terms and Conditions.

4. Appointment and Registration
The date and location of a coaching session are mutually agreed upon by the coach and client. Registration for events is only possible in writing via E-Mail, WhatsApp, or through a booking platform.

5. Offers, fees, and payment conditions
Offers are subject to change. For all offers, the fees published on the website and/or stated in the event advertisement will be charged.

All prices quoted are in DIRHAM (AED) and exclusive of VAT, unless otherwise agreed. Biling and payment in other currencies are possible. Unless otherwise agreed, invoices are generally payable immediately without deductions. In the event of late payment, further execution of the current contract may be suspended until the entire order has been paid in full. The client receives a confirmation and an invoice to transfer the amount on time.

6. Cancellation of a coaching appointment by the client
A personal coaching appointment can be canceled or re-scheduled free of charge up to two working days before the appointment. In the event of a later cancellation or postponement of the appointment, or in the even of a no-show, the fee for the agreed time will be charged in full.

7. Cancellation of a coaching appointment by the coach
The coach has the right to terminate collaboration or to cancel coaching sessions for important reasons, such as illness of the coach or force majeure, at any time. In the case of a termination or cancellation, only the hours worked are calculated. Further claims, in particular claims for damages, are not possible.

8. Data Protection
The client agrees that personal data will be stored and processed as part of the contractual relationship. All personal data will be treated confidentially and in accordance with our data protection policy. Please read our data protection policy on our website.

9. Liability
The coach is responsible for carrying out coaching, workshops, etc. carefully to the best of his knowledge and belief. There is no guarantee for the success of coaching or events. Thus liability is excluded. By making an appointment, the client confirms that they are acting on their own responsibility and thus relieving the coach from all liability claims. The client acknowledges that they are fully responsible for their physical and mental health, and is responsible for any damage caused.

10. Intellectual Property
All content on the website, including texts, books, images, graphics, logos, videos, and protected trademarks, are the intellectual property of the coach and may not be reproduced or used without explicit written consent. This also applies to documents that are handed over to the client as part of the coaching process.

11. Confidentiality
The coach is to maintain secrecy about all of the client’s professional, operational, and private matters that become known during the course of the activities, even after the contract has ended.

12. Place of performance and choice of law
Unless otherwise stated in the contract, the place of performance and payment is the place of business of the coach.

13. Severability clause
Any ineffectiveness of one or more provisions of these General Terms and Conditions will not affect the effectiveness of the remaining provisions. Instead of the ineffective provision, a replacement provision that corresponds or comes close to the meaning and purpose of the contract applies, which the parties would have agreed to achieve the same economic result if they had known that the provision was ineffective.
